PROCESS
Mediation can feel overwhelming at the outset. The process at Muxlow Mediation is designed to be safe, structured, and clear. Our five-step framework guides clients from the initial consultation through to a tailored agreement developed with—and for—the parties, with empathy, professionalism, and respect at every stage
Consultation (Free 30-Minute Meeting) Muxlow Mediation offers a complimentary 30‑minute consultation, available either jointly or in separate meetings. This introductory session provides an opportunity to discuss the issues to be addressed, review how the mediation process works, and consider whether mediation is an appropriate next step. Scheduling, fees, and anticipated timelines can also be outlined so clients can proceed with clarity and confidence.
1
Individual Intake The individual intake is a private, one‑on‑one meeting with the mediator completed before joint mediation begins. It allows the mediator to understand each party’s concerns and priorities, gather background information, and assess whether mediation is appropriate and safe for the circumstances. The intake also reviews the mediation process, confidentiality and voluntary participation, and helps identify the topics and information that will be needed to support productive joint sessions.
2
Mediation & Discussion Joint mediation is the stage where both parties meet together with the mediator to work through the issues to be resolved. The mediator facilitates respectful communication, helps clarify interests and options, and supports the parties in negotiating practical, workable solutions on topics such as parenting, support, property, and other family-related concerns. Sessions are structured and goal-oriented, with the pace and agenda tailored to the parties’ needs and the complexity of the matters being addressed.
3
Drafting & Final Review After the joint mediation sessions conclude, the mediator prepares the appropriate documentation based on the parties’ instructions—typically a Mediation Report and/or Memorandum of Understanding (MOU), and where requested, draft domestic contracts, such as a Separation Agreement. These documents capture all agreed-upon terms, which may include parenting plans, support calculations, Net Family Property statements and summaries, and any other relevant arrangements reached in mediation.
The draft is reviewed with both parties to confirm that the written terms accurately reflect the intentions and outcomes of the mediation. Next steps are then discussed, including Independent Legal Advice (ILA), any revisions arising from legal review, and practical implementation of the agreements. The objective is a clear, complete set of documents suitable for legal review and/or signing, so the parties can move forward with confidence and a workable plan.
4
File Closure Following final review and execution, Muxlow Mediation supports parties in closing the file in a clear and organized manner. If minor administrative amendments are required after signing (for example, changes requested by legal counsel or a government agency), these updates are completed at no additional cost. The mediator also provides straightforward instructions regarding signing, witnessing, filing (where applicable), and practical implementation of the agreement.
The completion stage is intended to ensure parties leave with a clear understanding of next steps—whether that involves divorce filings, implementing parenting arrangements, or completing property division and related transfers. The commitment is to support a smooth transition so the next chapter begins with clarity and confidence.
